1. Application

1.1 These membership terms (“Membership Terms”) set out the terms of your membership with Soul Barre.

1.2 References to Soul Barre, we, us or our mean Soul Barre Pty. Ltd. (ABN 56 602 966 085) and its associated entities.

1.3 You acknowledge and agree that:
1.3.1 Your membership is with the Soul Barre entity that owns and operates the studio you attend.
1.3.2 That entity is the contracting party for these Membership Terms.
1.3.3 These terms apply to all Soul Barre services, classes, events, and facilities.

2. Studio Rules & Regulations

2.1 Waiver

You must complete a liability waiver before attending your first Soul Barre class.

2.2 Class Cancellations

Soul Barre enforces a strict cancellation policy. If you reserve a class and fail to cancel within the required notice period, you may be charged a cancellation fee or forfeit the session.

All cancellations and changes must be made via the Mindbody booking system.

2.3 Waitlist

If a class is full, you may join the waitlist. You will be notified if a space becomes available. If you are not present 5 minutes before class start, your spot may be released.

2.4 Studio Rules

  • Clients must check in 5 minutes prior to class start

  • First-time clients must arrive 10 minutes early

  • Injuries or illness must be disclosed to the instructor

  • Pregnant clients require written medical clearance

  • Grip socks, towel, and water bottle are mandatory

  • Equipment must be wiped down after use

  • Respectful behaviour is required at all times

Soul Barre reserves the right to refuse entry if studio rules are not followed.

2.5 Personal Belongings

Clients assume all risk for personal belongings. Soul Barre is not responsible for loss or damage.

2.6 Minimum Age

Clients must be 12+.
Clients aged 12–18 must attend with a parent or guardian present.

3. Membership Packages

3.1 Membership Structure

Soul Barre offers monthly memberships with:

  • 6-month minimum term

  • 12-month minimum term

Memberships can be paid either weekly, fortnightly, monthly or in advance at 3,6 & 12 month intervals, and automatically renew unless cancelled in accordance with these terms.

3.2 Cancellation

Cancellations must be submitted in writing via:

Verbal cancellations will not be accepted.

A 30-day notice period applies to all memberships.

If cancelled before the end of the minimum term, a termination fee of 50% of the remaining balance will apply.

3.3 Fees

Membership fees are fixed for the term and are non-refundable, including unused classes.
Reactivated memberships are charged at the current advertised rate

3.4 Payment

Payments are processed through the Mindbody booking system unless an alternative direct debit arrangement has been approved in writing by both Soul Barre and the client.

By enrolling, you authorise Soul Barre to charge your nominated payment method for all fees due.

You must ensure sufficient funds are available.

If a payment fails, access to classes may be suspended until the account is brought up to date. A failed payment fee may apply.

3.5 Membership Entitlements

Memberships include:

  • Unlimited classes

  • Access to special events, challenges, and offers

Class timetables may change at any time.

Classes must be cancelled at least 2 hours prior to start time or they will be forfeited.

Clients must be checked in 3-5 minutes before class start or their spot may be released.

3.6 Membership Pauses

Memberships may be paused twice per year for a maximum of one fortnight with at least 30 days’ written notice.

Additional pauses may be approved at Soul Barre’s discretion under special circumstances.

Paused time extends the minimum membership term accordingly.

4. Termination

Soul Barre may terminate or suspend your membership if you:

  • Fail to make payment within 5 days of the due date

  • Breach these Terms and fail to remedy within 20 days

  • Accumulate 10 or more no-shows within 28 days

Upon termination:

  • Membership fees remain payable

  • Unused classes are forfeited

  • No refunds apply

5. Consumer Law

Soul Barre complies with the Australian Consumer Law..
Your statutory rights are not affected.

6. Limitation of Liability

By participating in Soul Barre classes, you acknowledge:

  • Physical exercise involves inherent risks

  • Participation is voluntary

  • Medical clearance is recommended

  • Serious health events may occur

You assume full responsibility for your health and wellbeing.

To the fullest extent permitted by law, you release and hold harmless Soul Barre Pty. Ltd., its instructors, staff, and contractors from any injury, loss, or damages incurred.

Nothing in these terms limits your Consumer Law rights.

7. Privacy & Miscellaneous

Soul Barre collects and uses personal information in accordance with Australian law. We do not onforward or share your details with anyone, business or entity. 

If any provision is invalid, the remaining provisions remain enforceable.

Soul Barre reserves the right to take video and photos of members for marketing purposes. Any video or photos will be of members who are over the age of 18.

Soul Barre reserves the right to amend these Terms at any time. Continued use of services constitutes acceptance.

LIABILITY WAIVER

By signing electronically through Mindbody and/or attending Soul Barre classes, you acknowledge:

  • There are inherent risks in physical exercise

  • Participation is voluntary

  • Medical clearance is recommended

  • Serious health events may occur

You assume all responsibility for your health and wellbeing.

You release and hold harmless Soul Barre Pty. Ltd., its instructors, employees, and contractors from any claims, costs, or damages.

This waiver applies to all current and future visits.

Clients must be 12+.
Clients aged 12–18 must attend with a parent or guardian present.
